synthetic-milk-contains-toxic-ingredients(NaturalHealth365)  While food tech companies promise consumers a “sustainable” future with lab-created alternatives to traditional foods, a new lawsuit has uncovered disturbing facts about what’s actually inside these products – and it’s nothing like what the manufacturers want you to believe.

Perfect Day, a leading food technology company, has been hit with a major lawsuit alleging “false, unfair, and deceptive marketing” of its synthetic milk protein “ProFerm” – a manufactured substance now hiding in ice cream, cream cheese, and “milk” products sold in thousands of stores nationwide.

The alarming truth behind synthetic “animal-free dairy”

Perfect Day boldly claims its synthetic whey protein contains “animal-free dairy proteins” that are “identical to those found in cow’s milk” with “a smaller environmental footprint than conventional whey protein.”  Their marketing materials insist the product is “identical to traditional milk.”

But devastating laboratory testing has revealed a completely different reality.

The Health Research Institute, an independent nonprofit lab, conducted rigorous mass spectrometry testing on milk products containing ProFerm and discovered shocking findings that should alarm any health-conscious consumer:

  • ProFerm is only 13.4% actual cow’s whey protein
  • A staggering 86.6% of ProFerm proteins are fungal proteins never before consumed by humans
  • ProFerm contained 93 fungal compounds not found in cow’s whey
  • “Milk” produced with ProFerm is missing 69 nutrients found in real milk, including critical omega-3 fatty acids and essential vitamins

“This is a nutritionally-devoid substance composed primarily of fungal proteins never before consumed by humans,” warns Diana Reeves, Founder and Executive Director of GMO/Toxin Free USA, one of the organizations behind the lawsuit.

The manufacturing process they don’t want you to know about

What makes these findings particularly disturbing is the way Perfect Day creates this synthetic protein while carefully avoiding terminology that would alert consumers to its true nature.

According to court documents, here’s what’s really happening:

“Perfect Day takes the natural gene for cow whey protein, beta-lactoglobulin (‘ß-lactoglobulin’), genetically modifies it, inserts the genetically modified gene into the genome of a fungus cell, and uses an industrial fermentation process to propagate large amounts of the fungal cells containing the modified whey gene.”

The company then adds chemicals to the resulting substance before dehydrating and packaging it.

The Non-GMO Project cuts through the marketing jargon, explaining that while the biotechnology industry is marketing this method as “precision fermentation” because it exploits a natural process, “it’s actually a form of genetic engineering.”

What’s even more alarming: Toxic chemicals found in testing

Beyond the nutritional deficiencies, laboratory testing revealed something truly concerning in products made with ProFerm – a fungicide called Benthiavalicarb-isopropyl.

John Fagan, PhD, a molecular biologist, former cancer researcher at the National Institutes of Health, and global pioneer in GMO testing, offered this disturbing explanation:

“I think the reason this fungicide is present is because they added it to the fermentation process to inhibit the growth of fungi that could contaminate the production system,” he said. “So the things that we see here are not really good for us, let me put it that way.”

How this slipped through regulatory cracks

Despite these alarming findings, Perfect Day has been allowed to market ProFerm to unsuspecting consumers for five years under a regulatory loophole that Alexis Baden-Mayer, political director for the Organic Consumers Association, calls deeply problematic.

Under current FDA rules, companies can simply “self-affirm” that their new food additives are “generally recognized as safe” (GRAS), essentially policing themselves without thorough independent testing.

“Allowing this aberration into our food supply without safety testing and classifying it as GRAS (generally recognized as safe) highlights the urgent need to reevaluate our regulatory framework for food,” Reeves noted.

The lawsuit comes at a significant moment, as Health and Human Services Secretary Robert F. Kennedy Jr. recently directed the FDA to eliminate this GRAS loophole on March 10.

Where these synthetic proteins are hiding in your food

Perfect Day’s synthetic proteins have already infiltrated “thousands of stores across the world,” according to the company’s own website.  Their partners include major food corporations like Nestlé and Mars, along with brands like Bored Cow, Myprotein, Coolhaus, Renewal Mill, Brave Robot, Juiceland, Nick’s and Strive Nutrition.

Products containing ProFerm now include ice cream, protein powder, cream cheese, non-dairy milk, baked goods, snacks and more – often with marketing that suggests they’re equivalent to or better than natural dairy products.

The lawsuit, brought in the Superior Court of the District of Columbia Civil Division, is demanding a jury trial and seeking an injunction to halt the deceptive marketing of ProFerm.  The plaintiffs are suing on behalf of themselves and the general D.C. public, alleging violations of the District of Columbia Consumer Protection Procedures Act (CPPA).

As P. Renée Wicklund, co-founder of Richman Law & Policy representing the plaintiffs, explained: “Manufacturers are more or less self-certifying, telling the FDA that they’ve looked at their own products and believe them to be safe.  And the FDA is sitting on the sidelines while those products move into the marketplace.”

Until regulators catch up with these new technologies, consumers would be wise to carefully scrutinize “alternative” dairy products and understand exactly what they’re putting into their bodies – especially when companies make claims that their lab-created products are “identical” to natural foods.
