A shocking victory for the government of Giorgia Meloni. The Court of Cassation has sanctioned the total legitimacy of detentions in the migrant centers of Albania, strengthening the Italy-Albania protocol and putting an end to months of legal battles. The decision, welcomed enthusiastically by the executive, marks a turning point in the management of migrant flows, consolidating the hard line of the center-right against illegal immigration.

The Supreme Court, accepting the appeal of the Interior Ministry and Rome Police Headquarters, has established that the Albanian centers, like the one at Gjader, are comparable to the Italian Detention for Repatriation centers (CPR).

The sentence reverses an earlier ruling issued by the Appeals Court of Rome, which had annulled the detention of a Moroccan migrant in Albania, raising doubts on its compatibility (and) agreement with European law. According to the Court of Cassation, the protocol signed by Meloni and Albanian Premier Edi Rama, is in full conformance with the law, which guarantees orderly and secure management of migrants awaiting repatriation.

As reported by Libero Quotidiano and Il Giornale, the Rome Appeals Court has already complied with the verdict, validating on May 8 and 9 the detention of migrants in Gjader. The rapid alignment shows the immediate impact of the decision, which closes the door to judgments hostile to the government line.

Premier Meloni didn’t hide her satisfaction, announcing that 25% of migrants detained will be repatriated within the weekend.

Italy is not only keeping its promise, but is accelerating the fight against illegal immigration. “This ruling shows that our vision is just and practical,” Meloni declared, quoted by Secolo d’Italia. The goal is clear: Transform Albania into a strategic hub for managing the influx, lightening the pressure on the Italian borders, and discouraging the journeys of hope.

A long and complex battle

The road to this victory has not been without obstacles. As reported by Il Messaggero, in the past months, several judges have contested the agreement, defining detentions in Albania as incompatible with European law. In January 2025, a ruling by the Court of Appeals had blocked the detentions, raising questions on the list of “safe countries”, and referring the question to the European Union Court of Justice (CGUE), whose opinion is expected in the spring. However, the Court of Cassation has drawn a line, at least on the national level, giving the government the freedom to proceed.

While celebrating the victory, one cannot ignore the critical context. The ruling of the Court of Cassation does not close the European debate: The CGUE could still reduce the Italy-Albania model, imposing constraints that would complicate Meloni’s plans. In addition, the opposition continues to criticize the externalization of migratory management, accusing the government of circumventing the fundamental rights of the migrants. However, the facts speak clearly: The protocol works, the repatriations are increasing, and Italy is showing that it can innovate in a field where Europe struggles to find common solutions.

The decision of the Court of Cassation is more than a legal victory. It is proof that the Meloni government knows how to translate electoral promises into concrete actions. In an era of unprecedented migratory challenges, Italy is raising its head, demonstrating that sovereignty and pragmatism can go hand in hand.
